Welcome to the Town of Colonial Beach Vendor Program

The Town of Colonial Beach offers a Vendor Program that allows approved vendors to operate in designated locations while serving residents and visitors. The program is designed to ensure vending activities are safe, well-organized, and contribute positively to the overall experience in Colonial Beach. If you are interested in becoming a vendor, please review the program requirements and submit an application to get started.

Before setting up shop in Colonial Beach, please submit the following:

βœ” Permit Fee Payment (due once the application has been reviewed and approved)
βœ” Proof of Liability Insurance
• Minimum coverage of $50,000 per occurrence
• Town of Colonial Beach listed as additional insured

PERMIT TYPES & FEES

During Season (April 1 - September 30)

Stationary Point of Sale

  • Full season using Town electric hookups  -  $2,000
  • Full season without Town electric hookups  -  $1,000
  • One-time full weekend (Fri, Sat, Sun)  -  $350
  • One-time single day (Fri, Sat, Sun)  -  $150
  • One-time single day (Mon, Tue, Wed, Thu)  -  $100

During Season (April 1 - September 30)

Mobile Point of Sale

  • Full Season  -  $1,500

During Off-Season

Stationary Point Of Sale

  • One-time full weekend (Fri, Sat, Sun)  -  $75
  • One-time single day (Mon, Tue, Wed, Thu)  -  $50

During Off-Season

Mobile Point Of Sale

  • One-time single day (any day of the week)  -  $150


VENDOR PROGRAM RULES & REGULATIONS

1. Program Eligibility
Weekend-only or daily vendor permits shall be limited to a maximum of four (4) permits per season. Each business participating in the Seasonal Vendor Program shall be permitted to hold only one (1) permit type per season.

2. Permit Required
It shall be unlawful for any vendor or peddler to display or offer products, goods, wares, merchandise, food, beverages, services, or rentals for sale on any municipal property without first obtaining approval from the Town Manager and complying with all regulations administered by the Town Manager or their designee.

3. Vendor Locations
Vendor locations shall be limited to designated spaces on Town Hill.

4. Event Coordination and Use of Vendor Space
Vendor permits issued for designated locations shall authorize use of the assigned vendor space on all days and weekends, unless otherwise directed by the Town. If a private event organizer hosts a permitted event, vendors shall coordinate directly with the organizer and comply with any applicable event rules, requirements, or vendor policies established by the organizer to operate during the event.

5. Permit Fees
All applicable fees shall be paid in full prior to the issuance of any vendor permit.

6. Parking Restrictions
Parking within the approved vendor or peddler location shall be prohibited except for the purpose of loading and unloading. Any vehicle parked in violation of this provision may be towed at the vendor’s expense.

7. Use of Assigned Vendor Space
Any vendor who fails to utilize their assigned vendor space for three (3) consecutive weekends may be deemed to have forfeited their permit, as determined by the Town Manager or their designee.

8. Product Variety
The Town Manager may deny an application if such denial is deemed necessary to promote a variety of products or services offered and to encourage the best use of Town property.

9. Noise Restrictions
The excessive use of loudspeakers, public address systems, amplified radios, or other sound-producing devices to attract public attention shall be prohibited. The determination of excessive use shall be made by the Town Manager or their designee on a case-by-case basis.

10. Trash and Cleanup
Each vendor shall be responsible for collecting, removing, and properly disposing of all trash or refuse generated by their vending operations.

11. Insurance Requirements
Each vendor shall file with the Town proof of liability insurance providing coverage for all claims for property damage and bodily injury, including death, arising from the vendor’s operations within the Town. Such insurance shall provide a combined single limit of liability of not less than fifty thousand dollars ($50,000) per occurrence.
a. The insurance policy shall be issued by a company licensed to do business in the Commonwealth of Virginia.
b. The policy shall name the Town of Colonial Beach as an additional insured.
c. The policy shall provide the Town with at least thirty (30) days written notice prior to cancellation or termination.

12. Health Regulations
Vendors selling food or beverages shall comply with all applicable regulations of the Virginia Department of Health.

13. Permits and Licensing
All vendors shall display all required permits and licenses while operating on public property, including a valid Town of Colonial Beach business license.

14. Pricing Transparency
Vendors shall clearly display all menu items or goods offered for sale along with the associated prices in a visible location prior to purchase.

15. Permit Transferability
Vendor permits shall be non-transferable. Vendor spaces shall not be sublet or assigned to any other individual or business under any circumstances.

16. Overnight Parking Authorization
Upon issuance of a valid vendor permit by the Town of Colonial Beach, a vendor may be authorized to park and leave their business vehicle overnight at the location designated in the permit, subject to all applicable laws and regulations.

17. Meals Tax Reporting
Vendors selling food or beverages within the Town shall remit meals tax payments on a monthly basis no later than the twentieth (20th) day of the month. Applicable forms shall be made available through the Town’s Finance Department. 

18. Permit Revocation and Enforcement
a. The Town Manager or their designee may revoke or suspend a vendor permit for any of the following reasons:

  1. Violation of any provision of these regulations;

  2. Failure to remit required taxes or fees;

  3. Failure to comply with Virginia Department of Health regulations or other applicable laws;

  4. Failure to maintain required insurance coverage;

  5. Excessive or repeated complaints regarding noise, safety, or other disruptive conduct; or

  6. Failure to occupy assigned vendor space for three (3) consecutive weekends without prior approval.

b. Prior to revocation or suspension, the Town Manager or designee shall provide written notice to the vendor specifying the violation(s) and allow the vendor an opportunity to correct the violation(s) within a reasonable period, unless immediate action is necessary to protect public health, safety, or property.

c. Any vendor whose permit is revoked or suspended shall immediately cease operations and remove all equipment, vehicles, and merchandise from Town property.

d. Vendors operating without a valid permit, or in violation of a suspension or revocation, shall be subject to fines, towing of vehicles at the vendor’s expense, and any other enforcement remedies available under applicable law.
